At least that's what Amtrak and Metro-North are saying in the ongoing saga about non-revenue movements by Amtrak on MN's lines. As we covered here, damage to Metro-North catenary by an Amtrak train is responsible for the most recent part of the feud.
StreetsBlog Empire State reports that Judge Jed Rakoff, known for high-profile cases including companies such as WorldCom and Citigroup, refused to grant an injunction requested by Amtrak which would have restored the intercity carrier's ability to conduct test runs and other non-revenue movements.
With Amtrak and Metro-North sharing tracks throughout the New York City-region (Amtrak's Lake shore Limited, Empire Service, Adirondack, Ethan Allen, and Maple Leaf operate over the commuter carrier's Hudson Line to reach Amtrak's portion of the former CSX Hudson Subdivision, while the Northeast Regional and Acela Express trains operate over MN's New Haven Line) there is no question this dispute will continue for quite some time and will provide plenty of fodder for conversation here at AllThingsTrains.com
